I have found another flat and it is a private tennancy, not through an agency. The vendor states that there will be no 6 month break clause in the contract as he is looking for long term tennants. He also wants a gurantor to secure everything. I understand this is normal practice although I am not too happy dragging a family member into the equasion. Now anyway, my question is; If I was to move into the flat and wanted to leave anytime before the 1 year contract is up, would it be possible with, for instance 2 months notice or would myself or my gurantor be liable for the rent for the rest of the stated contract time. You will be the one chased through the courts. A guarantor is only there to guarantee payment in full if all normal channels have been exhausted trying to get restitution. Q. This New York City collection agency called my son a "deadbeat" and threatened to padlock his business over a $500 vendor bill that he does not owe. Against my advice, he offered $250 to settle but was told if he did not overnight the full $500 his business would be padlocked. Is there an agency in New York we can complain too? We are no longer interested in settleing this. The offer was to avoid any hassle. Now it is a matter of principle. We will explore suing the agency as well. No, they cannot. Those actions are illegal. The FDCPA makes it a crime for a third-party collector to harass a debtor or threaten to take action they cannot legally perform. Debt collectors (attempt to) collect debts, they don't padlock businesses. Please realize it's a serious mistake to offer to settle on a debt not owed! Have you actually sent any money to the collector? (Doing so would tend to legitimize the debt.) I suggest you document everything you do and all the contact made by the collector; names, dates, and numbers. Then sue for damages.
