How do you dispute a collection agency when the vendor does not return you calls?
Q. They claim it was a medical appointment, yet I have no record of making a payment at the office and my insurance company has no claim form submitted for that date of service. The date is over a year ago and I never received a bill.
Asked by lmd6600 - Tue Aug 15 20:59:32 2006 - - 5 Answers - 0 Comments
A. Per the Fair Debt Collection Practices Act, you should send a letter via certified mail, return receipt to the collection agency disputing the debt. The collection agency has 30 days to respond to your letter with proof of the debt. If they do not, they cannot further collect on the debt. Keep a copy of the letter and the receipt for your records. If you continue to have problems with them, contact your state attorney general's office and the federal trade commission to file a complaint.

Online vendors and collections?
Q. I am curious what recourse an online vendor has for a disputed fee. What can a collection agency do if all the vendor has is your name and email address? The agency can not discuss a third party debt through email, and they can not report to the credit bureaus with just a name.

Victim of identity theft. Reported to police, credit agencies- no help. Is there way to contact FBI for this?
Q. Has been going on 5 years now. Lost my wallet at the beach, someone found it, is using my information to obtain credit. Has charged nearly $45,000 (yes, even bought a mobile home in my name). I have reported to police and have fraud alerts with the credit agencies now, but still getting collection notices from new creditors. I am in NC, the person that is doing all of this is in Georgia. I have been able to find out who it is that is committing this crime against me and even have address info on him, but don't know where to go from here. I have my own business and this is ruining me because I have to use my social security # when dealing with new vendors, and I'm being declined credit. It is affecting my business and personal life,… [cont.]

The FBI may get involved but I wouldn't count on it. Your best course of action is to go to the local police where you made the report and push the issue. Bring your evidence with you and demand to see the detective sergeant or watch commander. Explain your frustrations and push the issue. Is there a law that protects businesses from harassing creditors?
Q. I am familiar with The Fair Debt Collection Practices Act for consumers. Is there a law in California that protects businesses from the same harassment from collection agencies (phone calls at unusual hours, calling business vendors notifying them of debt)? A. I asked my girlfriend who is in consumer credit, here is what she wrote me: There are many laws and regulations in the way of consumer credit. Many times though the line is not clear because of personal guarantees and proprietorships. The best idea is to use caution and follow the consumer laws. It is also important to document everything. Most of the time using good judgment will keep you out of trouble. Don't make threats, if you say that you are going to do something you must follow through on it otherwise the customer can say you are harassing them. Such in the case of sending a 10 day demand letter stating that they will be turned over to collections if payment is not received within 10 days. Once you say this you must follow… [cont.]

What do you consider is the best way to obtain Residential and Lifestyle real estate listings in this market ?
Q. I am only talking of listings from 'realistic' vendors who want to work with a genuine consultant and Agency.

A. Let me know if you find something. I don't want to sound down but this is something that will be very difficult right now. People wanting to sell/more right now is a much smaller group. Some with company moves usually use realtors associated with the company. People just wanting to move, well they almost don't exist right now. Very few are willing to take the large losses they will see. The final group are those over their heads. These people are desperate and will be more alligned with people with the financial help. A lot of these will be lucky if they can do a short sale. A lot will end in foreclosure, I really feel for them but there isn't a lot than an individual can do.pp

Is it possible to keep stamp duty at 1% for the property priced at 255K? By paying estate agent fee?
Q. Hi I have offered 250K to a house near the place where I am renting now. But the vendor is expecting 255K. The estate agent fee that vendor has to pay to the agency is around 5000(including VAT). To keep the stamp duty at 1%, Can I pay that amount on the behalf of the vendor to the agent in cash(If the estate agent and vendor accepts)? Is this illegal? Will there be any issues ? Advanced thanks for your help & advice.

A. If your estate agent does this, he could be breaking the law. The best way is to approach the vendor, and pay 250k for the house and 5k for fixtures and fittings, your solicitor will be able to put that in a contract. With house prices as they are, why not offer 250, and site the reduction as the stamp duty. Most agents would ad this amount on with a property at that price.

A. Join the local Chamber of Commerce groups. You can join even if your business is not physically located in that particular community. You get listed in the directory, and the companies will call!

Legally can you be a vendor for a company if you don t have a business license?
Q. Ok I have been working for this company for over a year, I am satisfied with this company and it seems to me that so are they with my services . Though I am a temp they have plans for me to stay on board for years I have discuss things with my boss as what the status is for me to become a permanent (because the temp agency is charging a lot of money for me and I get only about 60% of it) my boss explained to me that they cant hire me directly because they do not have head count in the past I have gotten paid directly by the company for certain events can I just get paid as a vendor if I don t have a business license I just want to eliminate the temp agency so that I could get paid more and not be too much of and expense to the company.

Can my company use software that has an academic license?
Q. I work for a non-profit agency and want to procure computer software. Academic licenses are, of course, less expensive. I found a couple vendor sites that says that academic licenses can be used for education or commercial purposes. Is this really true?
Asked by Gus111111 - Thu Apr 20 14:58:40 2006 - - 3 Answers - 0 Comments
A. The short answer is "no". Academic licensing is expressly for the use of an academic institution or student. I would contact the vendor or software manufacturer directly. I have seen some software sites that gave licensing based on academic OR not-for-profit. I think it is up to each individual software manufacturer and what they decide. Most likely if you ask, they will give you a comparable license or reduced rate.

Why is a state like Rhode Island.....??
Q. so intense on the illegal immigration issue now? The debate over illegal immigration hit a frenzy pitch in Rhode Island last month when Republican Gov. Don Carcieri signed an executive order forcing state police and prison officials to identify illegal immigrants in state custody for possible deportation. It would also require state vendors and agencies under Carcieri's control to verify the legal status of future hires. Rhode Island isn't even a border state. Is this a sign of more to come? Can anyone from Rhode Island comment to explain what the burning platform is? What about other states? I hear Missouri also has pending state legislation.

I did a quick google and saw articles where illegal aliens were found working at the US Navy Undersea Warfare Center. There was also a case of illegal aliens getting hazmat drivers licenses. Honestly, I don't know if RI really is so intense about illegals. I know it is highly urbanised and has a fairly large hispanic community in Newport and Providence but does not have a high rate of violent crime. RI has a high cost of living and very high taxes and I'm sure people there feel vulnerable to the recession. The politics are also a mess there. So it is possible that Carcieri is responding to dissatisfaction by throwing a bone. It is just as… [cont.]

Q. I was asked in an interview if I have experience working with CRM agencies. I know CRM stands for Customer Relationship Management. I have worked with vendors in the areas of creative development and production of direct mail, as well as vendors who handle fulfillment of credit card rewards. Seems to me this is having to do with customer relationship, so I said I do have experience with CRM agencies. Am I in the right?

A. Yes. You have the basic idea of what CRM entails. Just know enough to talk the talk and you'll be fine.

I would like to acquire a food vendor permit for lake Mojave and lake Havasu a floating snack shop if you will
Q. I am having trouble finding a point with which to start as far as permitting is concerned, what regulatory agency would have jurisdiction for such a venture. Any ideas?

A. From my research, it appears that the laws and governing bodies differ between the counties. I can't find out which county those lakes fall into. So do a google search for the county and "mobile food permit" and you should find the agency you're looking for! Good Luck!
